These Terms & Conditions apply to the Dolphin app, website, and related test-preparation services (collectively, the "Service") provided by PaloAI Inc. (the "Service Provider").
By downloading or using the Application, you automatically agree to the following terms. It is strongly advised that you read and understand these Terms & Conditions carefully before using the Application.
The Application is provided on an "AS IS" and "AS AVAILABLE" basis.
Use of the Application
You agree to use the Application only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Application in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Application, servers, or networks
- Reverse engineer, decompile, or attempt to extract the source code of the Application
- Use the Application in a manner that could damage, disable, or impair its functionality
The Service Provider reserves the right to suspend or terminate access to the Application at any time if these Terms are violated.
Intellectual Property Rights
The Application, including but not limited to its content, features, functionality, trademarks, logos, and design, is the exclusive property of the Service Provider.
You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal, non-commercial purposes only.
You may not copy, modify, distribute, sell, or lease any part of the Application without prior written consent from the Service Provider.
User Accounts & Information
Certain features of the Application may require you to provide personally identifiable information, including but not limited to first name, last name, and email address.
You agree that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account.
SMS Verification Messages
Dolphin may send transactional SMS text messages to the phone number you provide for account sign-in, sign-up, and verification-code security. These messages are sent only when you request a code or otherwise initiate a phone-based authentication flow.
By entering your phone number and selecting Send Code, Send verification code, or a similar control, you agree to receive one-time verification text messages from Dolphin and PaloAI at that phone number. Message frequency varies based on your sign-in and verification activity. Message and data rates may apply.
Verification messages are not marketing messages. To stop receiving verification text messages, stop using phone-based sign-in or contact us at [email protected]. You can reply STOP to opt out where supported, and reply HELP for help where supported.
Sample message: Dolphin: your one-time verification code is 123456. Please do not share this message.
Promotional SMS Messages
Promotional SMS messages require a separate, optional opt-in. By checking the promotional-SMS consent box during signup, you agree to receive recurring marketing text messages from Dolphin and PaloAI about study tips, product updates, and offers at the number you provide. Consent is not a condition of creating an account or making a purchase.
Message frequency is up to 4 messages per month. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. You may also contact [email protected]. Carriers are not liable for delayed or undelivered messages. Opting out of promotional SMS does not prevent you from requesting transactional verification codes when you use phone-based authentication.
Sample promotional message: Dolphin: Keep your SAT momentum going with today's 10-minute lesson. Open Dolphin to continue your plan. Reply STOP to opt out.
Third-Party Services
The Application may use third-party services that have their own Terms & Conditions. By using the Application, you acknowledge and agree that the Service Provider is not responsible for the content, policies, or practices of any third-party services.
Subscriptions, Billing & Cancellation
Dolphin Premium is a recurring subscription. The price, billing interval, amount due today, renewal schedule, and any trial period are shown before payment. By subscribing, the purchaser authorizes the Service Provider and its payment processor to charge the selected payment method when the trial ends, if applicable, and at each renewal until the subscription is canceled.
Card statements identify Dolphin charges as DOLPHIN STUDY. Dolphin is operated by PaloAI Inc. A parent or other person who pays for a student's plan represents that they are authorized to use the payment method and accepts responsibility for the recurring charges shown at checkout.
A subscription can be canceled in account settings or by contacting [email protected]. Unless the checkout or applicable law states otherwise, cancellation stops future renewal and access continues through the paid billing period. Cancellation does not automatically refund a charge that has already been processed. Contact support promptly about duplicate charges, billing errors, or a refund that was promised but not received.
Disclaimer of Warranties
The Application is provided "AS IS" without warranties of any kind, whether express or implied.
The Service Provider does not guarantee that:
- The Application will function uninterrupted or error-free
- Any defects will be corrected
- The Application will meet your requirements or expectations
Your use of the Application is at your sole risk.
Limitation of Liability
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application.
This includes, but is not limited to, loss of data, loss of profits, or interruption of service.
Termination
The Service Provider may terminate or suspend your access to the Application immediately, without prior notice, for any reason, including violation of these Terms.
Upon termination, your right to use the Application will immediately cease.
Changes to These Terms
The Service Provider may update these Terms & Conditions from time to time. Any changes will be posted on this page.
You are advised to review these Terms regularly. Continued use of the Application after changes are made constitutes acceptance of the updated Terms.
Governing Law
These Terms & Conditions shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
